INFORMATION REGARDING THE PROCESSING OF PERSONAL DATA (PRIVACY) Pursuant to Legislative Decree 196/2003 “Personal Data Protection Code” and EU Regulation 2016/679

With reference to the provisions of Legislative Decree 196/2003 “Personal Data Protection Code” and EU Regulation 2016/679, in particular Articles 12 and 13, we inform you that your personal data will be processed in accordance with applicable legislation.

The requirements of the European Union’s General Data Protection Regulation (hereinafter “GDPR”) and other legal provisions are implemented, including, in particular, those of the Personal Data Protection Code (hereinafter “Privacy Code” or “Code”).

The data controller is MARINI E C. SRL , with headquarters in Reggio Emilia, at Via Quirino Majorana 15, 42049 Sant’Ilario D’Enza (RE), which is the controller of your personal data pursuant to the GDPR and the Code.

MARINI E C. SRL  may process any type of information relating to an identified or identifiable natural or legal person, and in any case as identified by Article 4 of EU Regulation 2016/679.

The data provided by our customers means all information you have provided to us to request the sale of goods and/or the provision of a service. This data may, for example, include: your first and last name, contact details (including address, telephone number, and email address), profession, date and place of birth, tax code, VAT number, and certified email address. Providing such information, if required by the contract or essential for its performance, is a necessary requirement for the conclusion of the contract; failure to provide such data may make it impossible for MARINI E C. SRL to conclude the Contract and/or to provide the related services and products.

Personal data means any information relating to an identified or identifiable natural or legal person. We will process your data only where permitted by law. Specifically, we will process your data pursuant to Articles 6 and 9 of the GDPR and on the basis of consent pursuant to Article 7 of the GDPR, in order to conclude and execute the requested contract and fulfill tax obligations.

We will process your data solely and exclusively for the purposes permitted by data protection legislation, such as: a) purposes previously approved by you; b) data processing for the purpose of executing the Contract; c) implementation of pre-contractual measures at your request; d) fulfillment of legal obligations to which we are subject; e) safeguarding our legitimate interests or the legitimate interests of third parties, unless your interests prevail; f) establishment, exercise, or defense of a legal right or claim; g) for reasons of substantial public interest; h) for tax purposes.

Among other things, we will process your data for the specific purposes listed below, for example:
– for purposes related to the Contract: primarily to execute the Contract entered into with you;
– to contact you regarding the Contract and to manage it;
– to offer you effective customer service, we will process your data regularly, for example, to provide you with comprehensive advice.

– to enable the management of requests for legal guarantees, product conformity, assistance, withdrawal requests, and management and termination of the Contract.

Your data will be processed pursuant to Article 5, paragraph 1, letter e) of the GDPR and will be retained only for the time necessary for the purposes for which it is processed.

If we process data for multiple purposes, it will be automatically deleted or saved in a format that does not allow any direct conclusions to be drawn regarding your identity, as soon as the last specific purpose has been fulfilled.

Indicatively, your data will be retained for the following periods:

– tax/administrative obligations: 10 years;

– regulatory obligations regarding product warranties: 28 months;

– contractual obligations regarding additional after-sales services: from 36 to 78 months depending on the chosen service.
